Zee Studios Seeks Bombay HC Release of Kangana Ranaut’s ‘Emergency’ Censor Certificate

Zee Studios, the co-makers of the upcoming film ‘Emergency’ to be starred by Kangana Ranaut, has moved Bombay High Court claiming to be extended an official copy of the film’s certification from the Central Board of Film Certification [Zee Entertainment Enterprises Ltd. v. CBFC- Ministry of I&B Gov. of India].

CBFC has not issued it yet Zee has said that it came to know from one of the news channels about the film certification on August 29, but CBFC has submitted no formal copy.

In light of the fact that the movie has been planned for release on the 6, of September, Zee Studios is now in a rush to seek relief from the court.

The plea, to be presented before a bench of Justice BP Colabawalla and Justice Firdosh Pooniwalla on Wednesday, adds that CBFC has unlawfully withheld certification.

Peculiarly, the CBFC has earlier in the day informed the MP High Court that till date the censor certificate to the movie has not been granted.

The CBFC stated this before the MP Court that the movie is yet to be considered and that it will not be released on September 6.

The MP High Court was also told that the film was certified last month but the same was trapped due to the objections. It was also pointed that even the certificate was e-mailed but the hard copy was not produced.

This stand of CBFC has been given an endorsement in the plea that was made with the Bombay High Court.

As per the prayer made before Bombay High Court, non issuance of the certificate violates the provision of the Cinematograph Act whereby certification has to be intimated in writing within five days in a format to any application for certification.

Zee has stated that without this certification, they will be unable to show the film and this will amount to the loss and detriment as well as violate Zee’s right to Freedom of Speech and the right to carry on any Profession or Business under Articles 19(1)(a) & 19(1)(g).

Emergency is a biopolitical drama that depicts one of the paramount historical events in India including the emergency in the year 1975.

The 1-minute trailer of the film was uploaded on Youtube on August 14, has garnered close to 300,000 views.

But soon after the launch of the trailer, PILs were moved in the High Courts of Madhya Pradesh and Punjab seeking stay on the release of the film stating that the film is portrayed the Sikh community in wrong light.
