Top Court Rejects Petition to Ban BJP’s Lotus Symbol
The Supreme Court on Friday declined to entertain an application for an interim order of injunction restraining the elections Bharatiya Janata party (BJP) from using ‘kamal’ or lotus as the party symbol
The Bench headed by Justice Vikram Nath and Justice PB Varale added that the petition was filed with the intention of gaining publicity.
”You want to get the name and fame for yourself and at the same time you want to give us the fame also,” the Hon’ble Court questioned the petitioner regarding the plea, asking “What is the relief claimed by you?”
The Court then went ahead to dismiss the petition for lack of merit without any reasons.

,was a petitioner in the civil suit for declaration and injunction in 2022 where he stated that the BJP which is a political party was not deserving for certain benefits which is entitled to a registered political party under the provisions of the Representation of the People Act.
Vipat had prayed for a permanent injunction against the party from claiming benefits for implementing policies which were against the registered commitment to the Election Commission of India at the time it was registering as a National Party.
He had also asked for an order of perpetual injunction to restrain them from ʹusing Kamal as a party symbol.
Due to some legal technicalities the civil suit was discharge my the court in October 2023.
After this, Vipat filed the Madhya Pradesh High court which also dismiss the application of Vipat leading to the appeal to the apex court.
In March this year, the Madras High Court had too declined a petition to quash the ECI to cancel the symbol of lotus flower to BJP filed by one T Ramesh.
There are many instances like it had been said the lotus flower is national flower of India, so it cannot be given to any political parties and it is disgrace to national integrity.
