On Wednesday, the Indian National Human Rights Commission (NHRC) suo moto took cognizance of human rights breaches that occurred in West Bengal’s Sandeshkhali area. Suo moto cognizance refers to the NHRC’s authority to take cases without requiring them to go through the customary legal channels, such as filing a petition or complaint with the NHRC. Allegations of sexual assault and harassment of “innocent and impoverished women” are among the infractions.
The NHRC claimed that the infractions “jeopardized” the safety and security of the local women, children, and senior citizens. As a result, a lot of people have fled their families “because sexual abuse and torture are looming large upon them.” The NHRC “exercises its jurisdiction under Section 12 (a) of the [Protection of Human Rights] Act, 1993” in response to reports of these incidents. The NHRC is tasked with “preserving, protecting, and promoting human rights, and taking suo motu cognizance of the reported incidents of violence,” according to this statute.
Following these abuses of human rights, the NHRC sent letters to West Bengal’s Director General of Police and Chief Secretary, requesting comprehensive information on the violent acts and the subsequent measures implemented by the authorities. In addition, the NHRC has requested information about victim compensation and corrective actions that local government agencies should take to restore public trust. It is anticipated that this information will be provided in four weeks.
Following the violence in this area, Shahjahan Sheikh, the district convenor of the Trinamool Congress Party, has been accused by the village’s residents of coercive land grabbing and sexual harassment. The village of Sandeshkhali has been rocked by protests led by local women demanding Sheikh’s arrest. Sheikh has escaped from the authorities since the protests began, apparently because his assistants fought a group of Enforcement Directorate personnel.
In a related development, a public interest litigation case is scheduled to be heard by the Supreme Court of India on Monday. It requests that the Central Bureau of inquiry (CBI) conduct an inquiry under court supervision into the incidents of violence and sexual harassment that occurred in Sandeshkhali.
