Supreme Court Rejects Plea to Ban Existing Polls

The apex court on Friday trading off a PIL petition to stop the poll as they interfere with the result. As stated in BL Jain v Union of India and ors

A Bench of Chief Justice of India (CJI) DY Chandrachud with Justices JB Pardiwala and Manoj Misra observed that it is not the job of the apex court the decide such matters and it’s the Election Commission of India (ECI) which should look into such matters.

He further observed, “The government is already elected now Let us now close the saga of what happens during elections and let us now get on with governance in the country.” “The Election Commission will take care of it and we will not run the Election Commission. This is a classic case of political interest litigation,” the CJI said while dismissing the petition.

Even the Delhi High Court had in May ruled that it cannot usurp the powers of the ECI that is a constitutional institution.

It was made during the hearing to a petition filed seeking direction to the police to register a criminal complaint against Prime Minister Narendra Modi for alleged communal speeches.

The petitioner in today’s case, one BL Jain, was present in person accompanied by lawyer named Varun Thakur.
