Supreme Court Sets Date for Final Hearing on Stray Dog Menace in India

The Supreme Court of India has taken a significant step forward in addressing the growing concern over stray dog attacks in the country. On November 1, 2023, the apex court scheduled the final hearing on this matter for January 10, tackling a batch of pleas, including one from the Kerala State Commission for Protection of Child Rights (KeSCPCR). This urgent plea highlights the increase in stray dog attacks, especially on children in Kerala, and calls for immediate and effective measures to curb this alarming issue.

Justice J K Maheswari and Justice K V Viswanathan, the presiding judges, have been deliberating over various petitions. Among these is an intervention application by the KeSCPCR and a plea from the Kannur district panchayat, seeking permission to euthanize dogs that are suspected to be rabid or pose a severe danger to the public. The Supreme Court‘s response to these matters will have far-reaching implications, as five High Court orders are being contested.

In a previous session, the Court expressed its intent to avoid interim directions and instead focus on a comprehensive review that would lead to concrete guidelines. This decision is aimed at reducing litigation in other High Courts regarding similar issues.

As the Court prepares for the final hearing, it has instructed that all pending services to respondents be completed within four weeks. It has also called for the compilation of affidavits and written submissions by December 15th, ensuring that all relevant material is ready for consideration.

This case, titled Animal Welfare Board of India vs. People For Elimination of Stray Troubles, represents a pivotal moment in India’s struggle to balance animal rights with human safety and welfare.
