SC restrains Uttar Pradesh government to adhere the order to prepare new list of 69000 assistant teachers
It was scaled down on Monday by the Supreme Court in the light of an Allahabad High Court order that the State of Uttar Pradesh had to prepare a new list of 69000 assistant teachers for recruitment.
The Bench comprising of Chief Justice of India (CJI) DY Chandrachud with Justice JB Pardiwala and Justice Manoj Misra sought for the response of the State to the batch of petition before the bench it formed and prohibited the alteration to the current recruitment list until further notice.
It has been further set for mention on September, 23rd.
The Bench was hearing appeals against an August 13 ruling of the Lucknow Bench of the High Court that declined to set aside the 2006 order of the All India Judicial Service Tribunal which had quashed the merit based selection of candidates.
The High Court has quashed the selection lists of assistant teachers released by the State authorities in June 2020 and in January 2022, which was containing 6,800 candidates belonging to reserved category.
That decision came while dismissing the appeals against a March 2023 order with regard to the contention that the reservation provided in those recruitments was not valid.
In today’s hearing in apex court, while joking, the CJI said:
This made me realise that there is so much of the crowd for this case! This is what is referred to as anticipatory mobilisation.
The teachers were represented by advocate Sahil Tagotra Before the Supreme Court. The State of Uttar Pradesh was represented upon the ground by Additional Solicitor General Aishwarya Bhati.
