A recent ruling from the Delhi High Court directed several media outlets, Facebook, Google, YouTube, and other unidentified parties to remove news articles and media links that featured purportedly slanderous and altered images of a female Bihar MLA for the Bharatiya Janata Party (BJP).
On February 20, the Court issued an interim order preventing certain news platforms from releasing the photographs.
The photos depicted the lawmaker “closely interacting” with a former political ally with whom she has since had some disagreements. The photographs, according to her, were altered.
Judge Prateek Jalan made it clear during the directives’ passage that news outlets are free to report on the factual dispute surrounding the images that went viral and the related proceedings, so long as the MLA’s claim that the images are altered and their authenticity are both acknowledged equally, are not to be discounted.
“If the concerned publisher has confirmed the authenticity of the images and wishes to pursue the defense of justification with regard to the images in question, the order will also not impede the publication of any images,” the Court stated.
The MLA filed an application with the court, claiming that her altered and slanderous photos had been shared on social media and printed by several media outlets.
She said that her former political associate posted the pictures.
However, the attorney representing the aforementioned political associate denied posting the pictures on social media.
After reviewing the case, the Court concluded that there was a prima facie case for an interim order since the legislator would suffer irreversible harm and loss if the relief was denied.
