The Supreme Court on term Friday rejected the request to put a stay order on the release of results of National Eligibility cum Entrance Test (NEET) 2024, which is the joint examination for candidates who aim to get seats in all medical colleges in the country [Vanshika Yadav v UOI & Ors].

The Court was hearing a plea seeking for redo of the exam after questions papers leak presented.

A three-Judge Bench headed by CJI DY Chandrachud intoned that it cannot put a stop to a national level exam, however a notice was issued to the Union Government with the registration of the petition and it has been asked to respond.

“It is with all heart that we will retain it until the end of the summer vacation, however, we cannot stop exam results that will only include persons from the entire nation,” the Court said.

This PIL (public interest litigation) was filed by Vanshika Yadav which was taken up freely by one Sunny Kadian, a lawyer.

According to the appeal, during the NEET undergraduate exam, picked by the national dailies revealed ahead the test date that question paper was leaked and wrong paper was given which meant that answer sheets were confusing and chaos were spread out (Hotchandani and Kalim).

“Nevertheless, some jarring incidents have been recorded at Patna, Bihar where the candidate has been caught by the State police who had been tipped off that some of the said accused had access to the test paper a full day before the exam,” according to the application.

The investigative team comprising of the Economic and Cyber Crimes Division – Bihar and Patna did a preliminary inquiry on the case and found that the leak had been done by a full-fledged gang. After the case was investigated, 13 individuals were arrested, and put into judicial custody.

The issue is hereby highlighted by different news interviews featuring people seeking to disclose or brands naming the raintuffer who is reportedly being paid the amount of ₹60 crore for Uttar Pradesh’s NEET paper.

Moreover, the whole leakage called into question a range of factors underlying the security of the test procedure including the focus on the integrity of the exam.

“Just as in the case of widespread paper leak of All India Pre-Medical and Pre-Dental Entrance Test- 2015 which was conducted under the umbrella of CBSE, the Hon’ble Court had quashed the changed exam and CBSE was directed to undertake the examination within a period of four weeks and further the investigation agencies were issued a directive to speed up the investigation process in the matter

Sharma, Sangwan and Yadav, appeared for the applicant, which is an aspiration of a medical sciences candidate for the UGME this year.
