MP John Brittas Writes To CJI Alleging Delhi Police Assault

When An Elected Lawmaker Faces The Baton

Imagine being a member of Parliament, elected by thousands of citizens, only to be bodily lifted and dragged across a street by law enforcement agencies. This is precisely what Rajya Sabha MP and CPI(M) leader John Brittas claims happened to him in the heart of New Delhi. Brittas has written a formal letter to Chief Justice of India (CJI) Surya Kant, seeking urgent judicial intervention and an independent probe into what he terms an appalling instance of police brutality.

The incident unfolded near Connaught Place during a demonstration over Chief Election Commissioner Gyanesh Kumar. According to the MP, law enforcement personnel crossed all limits of proportionality while dealing with a peaceful public gathering and a sitting legislator.

What Happened During The Protest?

According to the report, John Brittas rushed to the Connaught Place area after learning that youth activists were being detained and manhandled. He stated that he was peacefully speaking to journalists and exercising his democratic right to free expression when the situation escalated drastically.

Personnel from the Delhi Police and the Central Reserve Police Force (CRPF) allegedly grabbed, manhandled, and dragged him for roughly 50 metres. Despite repeated warnings from journalists and Brittas himself that he was a sitting Member of Parliament, officers lifted him bodily and hauled him toward a police vehicle.

The harassment did not stop once he was inside the van. Brittas alleged that officers pinned him to his seat and continued to assault him. He was eventually dumped by the roadside after a Deputy Commissioner of Police (DCP) reportedly ordered his release upon realizing the detention was completely unlawful.

What The Law Says: Constitutional Protections And Police Accountability

This high-profile complaint directly brings several core provisions of the Indian Constitution and criminal jurisprudence into the spotlight:

  • Article 19(1)(a) & 19(1)(b): Guarantees citizens the fundamental freedoms of speech and expression, and the right to assemble peaceably without arms.
  • Article 21: Protects the right to life and personal liberty, stating that no person shall be deprived of liberty except according to procedure established by law.
  • Article 32: Empowers individuals to move the Supreme Court directly for the enforcement of fundamental rights, which is the exact constitutional remedy Brittas has sought from the CJI.

Under Indian legal standards, any use of force by law enforcement must be strictly necessary, lawful, and proportional. Arbitrary detention and physical assault by state actors violate the bedrock principles of constitutional governance.

What Reliefs Are Being Sought?

In his communication to the Supreme Court, Brittas has argued that a fair investigation cannot be left to the Delhi Police or the CRPF, as their own personnel or supervisory officers are implicated. Instead, he has asked for:

  • An independent, court-supervised investigation by a Special Investigation Team (SIT) comprising officers unconnected to the accused forces.
  • Strict directions to preserve all digital evidence, including unedited video footage, vehicle movement records, wireless logs, and duty rosters.
  • Time-bound status reports submitted directly to the apex court.

The MP emphasized that peaceful dissent cannot be treated as a threat simply because those in power find it inconvenient, pointing out that several opposition leaders were similarly targeted.

Why This Matters For You

While this case involves a high-ranking Parliamentarian, the underlying legal questions apply equally to every ordinary citizen on the street. It raises crucial debates about executive overreach, the right to peaceful protest, and whether state machinery can be held accountable when basic constitutional safeguards are breached.

As this matter reaches the highest court of the land, all eyes will be on how the judiciary balances law enforcement duties with the fundamental freedoms guaranteed to every individual in a democracy.
