Actor Imran Khan Moves Bombay High Court Against Deportation Notice

Why Bollywood Actor Imran Khan is Heading to Court

Bollywood actor Imran Khan is preparing to move the Bombay High Court. He is challenging an official notice that orders him to leave India by October 28. The notice comes after immigration authorities accused him of violating rules under the Foreigners Act.

Once filed, his legal team plans to ask for an urgent hearing before a division bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna. Legal firm MZM Legal LLP is representing the actor in this high-profile matter.

What Sparked the Controversy?

The entire trouble started on October 10. Imran Khan was detained during a public demonstration at Mumbai’s historic August Kranti Maidan. The protest was directed against Chief Election Commissioner Gyanesh Kumar.

Following the demonstration, Bharatiya Janata Party (BJP) leader Kirit Somaiya filed a formal complaint at the Gamdevi police station. The complaint alleged that Khan, who holds United States citizenship, broke the law by joining a local political protest. The local police then forwarded this complaint directly to the Foreigners Regional Registration Office (FRRO) for action.

What The Law Says

Imran Khan is an Overseas Citizen of India (OCI) cardholder. While the OCI scheme allows foreign nationals of Indian origin a lifelong visa to live and travel in India, it does not give them full Indian citizenship. OCI cardholders do not enjoy political rights, meaning they cannot vote or contest elections in India.

Under the Immigration and Foreigners regulations, the Central government has the legal power to order a foreign national to leave the country or a specific area. The FRRO relied on these provisions and his US citizenship to issue the expulsion order, directing him to exit India on or before October 28.

What Happens Next

The case will soon reach the Bombay High Court bench for a formal hearing. The court will examine whether the administrative action taken by the FRRO was legally sound. It will also look at the extent of restrictions placed on OCI cardholders when they participate in public demonstrations.

Why This Matters For You

This case highlights the strict legal boundaries that apply to foreign nationals and OCI cardholders living in India. While people enjoy the right to free expression, foreign citizens do not possess the same political privileges or protections as Indian citizens under local electoral and immigration laws.
