Delhi High Court to Notify MS Dhoni of Defamation Suit Amidst Contract Breach Allegations

In a recent development that intertwines the world of sports and law, the Delhi High Court has decided to inform cricket icon Mahendra Singh Dhoni of a defamation suit filed against him. The lawsuit, filed by former cricketer Mihir Diwakar and his wife Soumya Das, pertains to alleged defamatory remarks in relation to a contractual dispute dating back to 2017. Justice Prathiba M Singh, overseeing the case, has directed the court’s registry and the plaintiff to intimate Dhoni, with the hearing scheduled for January 29.

The dispute centers around a contract signed between Dhoni and Aarka Sports Management, owned by the plaintiffs, for establishing cricket academies both in India and globally. This ambitious project, intended to harness Dhoni’s brand for promoting cricket training, has now become the subject of a legal tussle.

The plaintiffs have accused Dhoni and his representatives of making defamatory allegations against them, including claims of financial impropriety. According to the suit, Dhoni’s legal team, led by Dayanand Sharma, held a press conference in January 2024, where they leveled these accusations. The media coverage of these statements, argue Diwakar and Das, has damaged their reputation.

In a twist to the tale, Dhoni had earlier filed a criminal case in Ranchi against Diwakar and Das, alleging violations of the 2017 contract. This complaint under various sections of the Indian Penal Code, including criminal breach of trust and cheating, alleges that the plaintiffs continued to open cricket academies under Dhoni’s name even after his authorization was revoked.

The Delhi High Court, while addressing the defamation suit, emphasized the necessity of informing Dhoni about the proceedings before moving forward. In an era where media reporting can significantly influence public opinion, the Court’s approach underscores the importance of due process and fair hearing.

Advocate Siddhant Kumar, representing news agency ANI, one of the defendants in the case, argued that the suit against the media outlet is not maintainable as it only reported on the criminal proceedings in Ranchi court.

As the legal proceedings unfold, this case highlights the complex intersection of celebrity branding, contractual agreements, and the role of media in reporting legal disputes. It raises pertinent questions about the responsibilities of public figures and media agencies in handling sensitive information, especially in high-profile cases involving renowned personalities like MS Dhoni.

The outcome of this case will not only affect the parties involved but may also set a precedent in how contractual disputes and defamation claims involving public figures are handled in the Indian judicial system.
