Delhi HC Orders Universities to Provide EWS Quota Circulars in Hindi

It is noteworthy that recently the Delhi High Court passed an order to direct the Directorate of Education (DoE) of Delhi to make all the circulars and notices related to the admission for any educational institution for the EWS category in Hindi also[Master Harmanpreet Singh through Mr. Paramjeet Singh vs. Directorate of Education].

The Honourable Judge Swarana Kanta Sharma remarked that since they are characterised as belonging to the economically weaker section they would not perhaps have adequate English understanding, and that the issue of these circulars only in English hinders in language barrier.

“In my opinion, the notices/circulars which are issued by the Directorate of Education should not be limited to English language alone those circulars which are related to admissions under the EWS category and those circulars which describe the guidelines and mandatory documents which are required to be uploaded by the parents of such candidates since this results into communication and compliance related difficulties for the candidates for whom these circulars are issued,” the Court stated while noticing that many parents

The Court passed the order on a plea made by a parent seeking admission of his/her child to a kindergarten school under the EWS quota.

The Court also dismissed the petition after observing that the parents of the child had not provided the valid income certificate before the process of admissions as per circulars on EWS quota admission guidelines.

The parents further complained that they did not have the valid certificate before going through the admission process because they were not aware that the income certificate they received earlier expired.

Since the parents failed to produce valid income certificate before the start of admission the Court upheld the school’s argument that they had a right to reject the school admission application.

It is pertinent to note that the Court did not lose sight of the fact that through English circulars given by the DoE, parents seeking admission under the EWS quota were exposed to language barrier.

What this Court further notes that the said parents are from the vulnerable economic bracket and are illiterate as it goes with most of the parents in many other cases. They are usually ignorant of the requirements by the DoE on the validity of an income certificate as well as upload and submit the valid income certificate as on the date of applying for such admissions. The situation is worsened by lack of reasonable grasp of the English language and, to the extent that one is not even aware of this very strict requirement on validity of income certificate,” the court said.

The following directions have been passed by the Court in order to deal with such barriers so that these circulars are also issued in Hindi.

– However, for the purpose of achieving a maximum impact, it is mandatory that such notices are also published in Hindi as it is also very much spoken and understood by a good number of people. This approach of undertaking this reading in two languages will assist in future to eradicate such non-compliance as a result of language that hinders citizens in accessing their rights and opportunities provided for under the law with especial attention of the disadvantaged.

– DoE will ensure that the details of the validity of the income certificate and other documents required and to be furnished by the parents applying for admission under EWS category is disseminated. They will also upload details about documents needed to be submitted for admission under EWS category in Hindi which can easily be understood by the people of Delhi.

– DoE may upload a video which describes the steps involved in applying for admission under EWS category, which should also state about the provision for a valid income certificate and what is a valid income certificate and other documents a candidate/applicant which he/she has to upload. Such videos should be prepared in Hindi and English and any other language as used in India as a second language.
