In reply to Para 1 of the application it is not denied that the plaintiff has filed a false, frivolous suit in this Court. It is also submitted that the allegations made in the plaint are entirely false, baseless, untrue and concocted one. The defendants are filing herewith written statement. The same may be read as part of this reply, which shows the correct facts, 2. Para 2 of the application is wrong and is denied. 3. Para 3 of the application is not denied. 4. C. would not be applicable at the stage of granting interim relief in a petition under Arts. 226 or 227 of the Constitution, but at the same time various principles laid down under Order 39 for granting ad-interim or interim reliefs are required to be taken into consideration.2 INJUNCTION — DISCRETIONARY RELIEF Order 39 Rules 1 and 2 Injunction is a discretionary relief which cannot be extended in favour of a person who is in arrears of a huge amount of Licence fee. 3 COURT NOT TO HOLD MINI TRIAL AT STAGE OF GRANTING TEMPORARY INJUNCTION It may not be appropriate for any Court to hold mini trial at the stage of grant of temporary injunction. 4 1.
