Bengaluru Civil Court orders Google to preserve an ex-Gmail employee’s account.

An ex-parte temporary order was recently issued by an Additional City Civil Court in Bengaluru, directing Google India to keep an ex-Gmail employee’s account, as well as all of its data, until the next date of hearing.

The plaintiff had shown a prima facie case, so the court issued an injunction prohibiting Google from transferring control of the email account, cancelling, surrendering, or reading the emails received by the ex-employee until the next hearing date.

In this situation, the employee refused to give the password to his Gmail account, which he had used during his time with the company.

When he discovered that his account had been erased after he resigned, he went to the City Civil Court to ask the court to require Google to save the account and its data.

Advocates Vijay Pal Dalmia and Rajat Jain of Vaish Associates, as well as Advocate Keshav M Datar, represented the plaintiff.
